Insurance claims can get expensive, but one wrongful termination lawsuit lawyer says it can be cheaper than an auto accident lawyer.
“Insurance claims are often very complicated, expensive and time consuming,” says wrongful termination law attorney and wrongful termination litigator, Brian A. DeMarco.
“So if you want to have a legal defense in the event that you’re injured or a wrongful death claim is filed, it may be cheaper for you to hire an attorney.”
DeMarco also notes that it’s important to remember that attorneys who have been hurt or who have died in the line of duty do not necessarily have all of the facts, and the attorneys they represent should not be held liable for any of the circumstances.
DeLucas said that it can cost upwards of $1 million to litigate a wrongful wrongful termination claim.
But that doesn’t necessarily mean that the lawyers who are representing you can afford the legal fees that the wrongful termination claims attorney will likely charge.
De Marco also noted that attorneys are typically not the ones who decide if the insurance company will cover the claims.
“I don’t know of any wrongful termination attorneys that are not a client,” DeMarco said.
De Lucas has been representing clients suing companies for wrongful termination for more than 20 years.
“Most of the attorneys who are litigating wrongful termination cases for wrongful death claims are not going to represent you,” he said.
“They are going to be representing the insurer.”
DeLucis said that if you have been injured, you should contact an attorney to discuss your claim.
“You may want to call your insurance company,” De Marco said.
However, he also cautioned that the best advice is to talk to a lawyer before making any legal claims.
De Louis said that the most important thing is to be able to provide a reasonable explanation for why your claim is frivolous.
“It may be that you have nothing to prove,” he added.
“If that is the case, you have no chance of winning.”
De Marco has represented clients in wrongful termination lawsuits for more of his career, including wrongful termination of a driver for allegedly killing his dog.
“In many wrongful termination actions, the driver is not even prosecuted for the killing of the dog,” he noted.
De Lucas also said that he has represented many people who have lost their lives in automobile accidents, but they don’t usually seek his help because they know that he can’t help them.
“A lot of these people will just tell me that they want me to represent them because they don�t have the resources to hire a lawyer,” he explained.
“When they go to the doctor, the doctor is going to have to find out that the dog killed their dog, but if they are going through an accident, I can get them covered.”
De Lucis also said it can make it more difficult to defend a wrongful loss claim, and that the attorney can only be expected to provide “a minimal level of legal representation” when filing a wrongful disability claim.
De Lucia said that insurance claims are also “extremely expensive,” with some insurance companies charging upwards of a million dollars for claims that may not even go to court.
De Luce said that wrongful death lawsuits are often filed by insurance companies who are not licensed to practice law in the state, and they often do not have enough resources to afford a lawyer to represent a client.
De Luces said that some wrongful death lawyers are charging hundreds of thousands of dollars for wrongful disability claims, but the attorneys that he represents will usually charge $1,000 or less for a claim.
The attorney will usually need to prove that the client suffered some type of harm or death, De Luces added.
De Loucis said he has handled wrongful death and wrongful disability cases involving many people.
“There are a lot of people who are injured and have died as a result of a wrongful action and there are a whole lot of wrongful deaths,” he concluded.
DeLuis also mentioned that it may take a lot more time for a wrongful claim attorney to file a wrongful injury claim, since they typically only have a few weeks to prepare for a lawsuit.
But he noted that wrongful claims attorneys are usually able to recover damages if they can show that the company that hired the attorney did not provide the legal assistance it should have provided.
De luce added that insurance companies may not reimburse a wrongful claims attorney if the attorney has been injured or killed in the course of his or her legal work.
“Sometimes insurance companies will reimburse you a portion of the money you spend defending your claim,” he pointed out.
DeLuce said it’s usually cheaper for the wrongful claim attorneys to file an insurance claim rather than a wrongful dismissal claim, but De Luca also noted there are cases in which it may make more sense for a lawyer in the case to file the wrongful dismissal.
